Terms of service
1. Who this is between
These terms are between you and ProxyMonkey (“we”, “us”). By creating an account or sending traffic through our network you accept them.
2. What we provide
Access to residential, ISP and datacenter proxy networks, billed by the gigabyte of traffic. We do not guarantee that any particular website will be reachable, that any particular IP will be unblocked, or that a given success rate will hold — those depend on third parties we do not control.
We aim for high availability and publish incidents to our status bot. We do not offer a contractual uptime guarantee, and we would rather say that here than bury it.
3. Your account
- You are responsible for keeping your credentials secret.
- Traffic sent with your credentials is your traffic, including traffic sent by someone who obtained them from you.
- You must be old enough to enter a contract where you live, and not be barred from receiving our services under applicable sanctions law.
- One person or organisation, one account. No credential resale.
4. Acceptable use
Your use must comply with our acceptable use policy, which forms part of these terms. Breaching it can result in immediate suspension. Where we suspend an account for abuse, we refund the unused balance rather than keep it.
5. Money
- Service is prepaid. Minimum top-up $5. Your balance does not expire.
- Traffic is billed per request against your balance at the rate attached to the top-up that funded it.
- The rate on a balance you have already paid for does not change. If our list prices change, the change applies to future top-ups.
- Refunds are governed by our refund policy.
- Prices exclude any taxes that apply where you are.
6. Metering
We bill for request bytes and response bytes, including headers and protocol overhead on the tunnelled connection. Connections that fail before transferring data are not billed. Retries that you initiate are billed and appear as separate entries in your usage log.
Your usage log is the record of what we billed. If you believe it is wrong, tell us — if our figure exceeds actual usage, we refund the difference.
7. Suspension and termination
We may suspend or close an account that breaches these terms or the acceptable use policy, that we are legally required to act on, or that is causing harm to our network or our IP pools. Where we can give notice first, we will.
You may close your account at any time. Unused balance is refundable under the refund policy.
8. Liability
We provide the service as-is. To the extent the law allows, our total liability to you for any claim is limited to the amount you paid us in the three months before the claim arose. We are not liable for lost profits, lost data, or consequential loss.
Nothing here limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.
9. You are responsible for what you do
Proxies are a general-purpose tool. Whether your particular use of them is lawful in your jurisdiction and compliant with a target site’s terms is your responsibility to determine, not ours. We do not give legal advice about your scraping.
10. Changes
We may update these terms. Material changes will be announced in our Discord and by email at least 14 days before they take effect. If you do not accept a change, you may close your account and take a refund of your unused balance.
